Quantity Surveyor/Claim Management

An exciting opportunity for an experienced Quantity surveyor/Claim management has arisen for a leading international group serving the defense markets in Australia and throughout the world. The successful candidate will have extensive experience in the investigation and negotiation of agreements relating to the suspension of projects and associated penalties to involved parties. Monthly travel to the Asian region will be required to consult with key stakeholders.

It is critical that the successful candidate has an understanding of complex projects, ideally from the mining or, construction industry and a strong background in civil engineering and strong commercial experience.

This position is initially a fixed term contract and will be required only until commercial claims are resolved. Working with the project team and liaising with the civil works contractor, the Claims Manager will be responsible for managing all aspects of claim preparation, submission, and negotiation.

THE ROLE INCLUDES THE FOLLOWING ONGOING ACCOUNTABILITIES:

- Identifying all components of the claims, defining the contractual basis of claim for each component,
- Defining the financial basis of claim and how it is to be presented and supported, and leading the team in preparation of the claim packages.
- Identifying non-financial impacts of the claim, and providing proposed mitigations (eg amendment of contract terms).
- Preparing overviews, summaries and presentation materials.
- Coordinating internal reviews in accordance with businesses processes.
- Coordinating the basis of claim, presentation formats and submission of claims with the civil contractor.
- Leading negotiations on behalf of the business, drafting correspondence, and other written materials in support of the claim and in face-to-face discussions, maintaining records of negotiation.
- Recommending presentation strategies and settlement terms to the businesses management.
- In conjunction with legal staff, documenting negotiation outcomes and preparing relevant commercial agreements.
- Overseas travel will be required on a monthly basis to the Philippines for up to a week at a time (this is subject to change)

THE SUCCESSFUL CANDIDATE WILL HAVE;

- Tertiary qualification in law (or comparable management discipline) or equivalent experience.
- Working with complex contractual make-ups and international/multicultural environments
- Complex system delivery projects and after sales support contracts.
- Experience in preparing and leading complex negotiations, including disputes.
