Employee Relations Advisor

Bank of America is currently looking for an experienced Employee Relations Advisor to deliver ER counselling and advice to managers and employees on policy and procedure. Advice will cover complex and sensitive issues as well as routine to moderate policy and process questions which are typically around performance improvement processes, lateness, sickness absence, conduct disciplinary issues and informal grievances.

Responsibilities
As an Advisor, the role will be responsible for the following:
Case Management:
* Manage cases, supporting Managers and liaising with consultants and the Case Management team as applicable on the management of:
- flexible working and home working requests together with declines and appeals
- assist managers to address declining or under performance through coaching managers and associates, the creation of effective PIP's and manage the case through various stages of warnings through to dismissal
- management of long term absence cases, OH onsite absence review, return to work meetings
- provide support and guidance to associates and managers on the GIP process, liaise with the GIP provider and Occupational Health where appropriate to provide the relevant documentation and information, handle appeals, manage return to work process.
- facilitate the timely collection of data for DSARs

* Follow through with staged warnings through to dismissal on PIP, absence cases, performance cases, exam failures and probationary dismissals.
* Where possible shadow and assist Case Management and legal team on the management of more complex disciplinary, grievance and redundancy cases.
* Assist AR Case Managers with other matters requiring support such as conducting investigation meetings and suspensions.

Advice:
* Provide coaching, guidance and advice in a timely and accurate manner to Managers, Associates and consultants within guidelines and established precedents to obtain the appropriate outcome for the Bank on all policies, processes and employment risk issues owned by AR.
* Provide appropriate and accurate documentation and follow up to support that advice.
* Use Siebel to track all issues raised to the Advisory team and to close tickets referred by the HRSC to AR to facilitate reporting.
* Evaluate and assess the trends and make recommendations regarding education or feedback resulting from such trends.
* Resolve matters informally where appropriate to reduce formal actions.
* Work with ISD/Life Events/Staffing on issues of hand-over between the units to ensure that processes are clear and well defined.
* Work with Case Managers to present a co-ordinated approach to AR matters, escalating matters to them and picking up cases from Case Managers, as appropriate.
* Hold bi-weekly 1-1s to ensure information is shared about ongoing cases.
Employee Relations Related Projects:
* Lead and/or contribute to other AR related projects that arise throughout the year such as process review/design and policy development.
* Assist Learning and/or the generalists in the development of education decks and training materials around AR subjects and participate in this training where appropriate.
* Continue to work with the new HRSC and Life Events team and contribute to the update and harmonisation of policies and processes within the AR remit as a result of the new structure.
* Provide training and coaching sessions/workshops to managers as appropriate eg new Policies, Performance Management Training, New Manager Training etc. as required.
* Assist the Case Management and HR teams in the delivery of strategic projects as required.

Requirements
* Deep subject matter technical and functional expertise in the application of employment law, HR policy and process gained through working in an employee relations function or an employment legal practice.
* Ability to manage and prioritise numerous and often conflicting objectives, projects or activities simultaneously. Must be comfortable working under pressure whilst maintaining attention to detail.
* Ability to make decisions balancing the risk reward trade off.
* Ability to operate independently on own initiative.
* Excellent interpersonal, analytical and organisational skills are required in order to interact with all levels of management and staff.
* Excellent verbal and written communication skills.
* Excellent questioning and listening techniques accompanied by sound reasoning.
* Strong counselling and advising skills balanced with influencing techniques.
* Positive attitude.
* Operate effectively at all levels within the company and know the business.
* Must be flexible in adapting to a dynamic, fast paced environment.
* Must understand component parts of HR and their responsibilities to ensure that queries are handled by the appropriate team.
* Exposure to dealing with highly confidential information and a proven record of remaining confidential at all times.
* CIPD qualified/part qualified.
